Senator Maria Cantwell, who chairs the Senate Committee on Commerce, Science and Transportation, said she would convene a full nominations hearing on Sept. 20. Ferguson was chief counsel to U.S. Senate Republican Leader Mitch McConnell from 2019 until 2021. Holyoak is the Utah Solicitor General with the Utah Attorney General's Office.

WASHINGTON, July 3 (Reuters) - U.S. President Joe Biden has nominated Virginia Solicitor General Andrew Ferguson and Utah Solicitor General Melissa Holyoak to fill Republican slots at the Federal Trade Commission, the White House said Monday. The FTC "operates best at full strength, and I will look forward to working with them," she said. A native of Virginia, Ferguson has an undergraduate degree from the University of Virginia and a law degree from the University of Virginia School of Law. Holyoak is the Utah Solicitor General with the Utah Attorney General's Office. Her undergraduate degree is from the University of Utah, as is her law degree.

Critics have said such awards encourage frivolous lawsuits and excessive fees going to class action attorneys who may seek to benefit their own interests instead. The Supreme Court in 2019 sidestepped resolving a challenge to cy pres awards in a case involving Google. Conservative Justice Clarence Thomas, dissenting in that case, called cy pres settlements "unfair and unreasonable." Monsanto has called the group, which advocates against what it considers abusive class action procedures, a "serial objector to class-action settlements." The group said in court papers that further steps could have taken to distribute the settlement award to class members.

According to class counsel, Godiva recently directed Kroll “to conduct several additional rounds of review” of class claims that had already been validated. Adding to the intrigue: In September, class counsel told Preska that Godiva had informed them that the company did not have enough money to pay class members. It's also rare, Frank said, for class counsel to ask a judge to get involved in the post-settlement claims administration process.
